By downloading, accessing, or using Smart Beach, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services. We may offer additional features, partner services, or promotions; where separate terms apply, those terms will supplement or override these Terms for the specific offering as stated.

Smart Beach is intended for users who can form a binding contract under applicable law. You are responsible for ensuring that your use of the platform complies with laws in your jurisdiction.

2. User Responsibilities

You agree to:

Provide accurate, current, and complete information when creating bookings or an account.
Keep your login credentials confidential and notify us promptly of unauthorized use.
Use the services only for lawful purposes and in accordance with these Terms.
Not misuse the platform (for example, by attempting to interfere with security, submitting fraudulent bookings, or harassing providers or other users).
Comply with instructions from hotels, activity operators, rental partners, and local rules at your destination.

3. Booking & Payments

English

Listings, availability, prices, and inclusions are shown as provided by partners and may change before confirmation. A booking is formed when you receive confirmation through Smart Beach (or the partner’s process linked from the app), subject to the partner’s terms and any deposit or payment rules shown at checkout.

Payments may be processed by us, our partners, or third-party payment providers. You authorize charges you approve at the time of booking. Taxes, fees, and currency conversions may apply as displayed. If a payment fails or is disputed according to the applicable provider’s rules, the booking may be cancelled or amended.

You are responsible for reviewing booking details (dates, guest count, vehicle type, activity requirements, ticket conditions) before confirming. Errors should be reported as soon as possible so we or the partner can assist, subject to partner policies.

4. Cancellation & Refund Policy

Cancellation, modification, and refund rules depend on the specific product (hotel, car rental, activity, ticket), the partner’s policy, and the fare or rate you selected. These rules are shown before you confirm a booking where practicable.

Within policy: Cancellations or changes made in line with the stated policy may receive a refund or credit as described at booking.
Non-refundable or promotional rates: May not be changeable or refundable unless required by law or explicitly stated otherwise.
No-shows and late arrivals: May result in charges or forfeiture of fees according to the partner’s terms.
Processing: Approved refunds are typically returned to the original payment method; timing depends on banks and payment processors.

For disputes or exceptional circumstances (e.g. force majeure), contact us at info@smartbeachmm.com. We will work with partners where reasonable but cannot guarantee outcomes outside published policies.

5. Use of Services

Smart Beach provides a platform to browse, compare, and book travel-related services. We may show content, maps, estimates, and AI-assisted information to help you plan. Such information is for convenience and may not always be complete or up to date; always verify critical details with the partner before travel.

Third-party services (including rides, payments, maps, or analytics) may be subject to those third parties’ terms. Your dealings with hotels, rental companies, and activity operators are ultimately between you and those providers, while these Terms govern your use of Smart Beach itself.

6. Account & Security

Certain features may require an account. You must provide accurate registration information and safeguard your password and device access. You are responsible for activity under your account unless you can show unauthorized access despite reasonable care.

We may suspend or terminate accounts that violate these Terms, pose security risk, or as required by law. You may close your account through in-app options where available, or by contacting us; some data may be retained as described in our Privacy Policy.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Sun Light Company and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of Smart Beach or third-party services booked through it.

Our total liability for any claim arising out of or relating to these Terms or the services is, where permitted, limited to the greater of (a) the amount you paid to us for the specific booking or fee giving rise to the claim in the three months before the claim, or (b) a nominal amount where no payment applied.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence where such limitation is prohibited.

Continued use after the effective date constitutes acceptance unless applicable law requires a different process.
